Legal terms governing your use of Ironmind's platform and services.
Welcome to Ironmind. These Terms of Service ("Terms") govern your access to and use of Ironmind's mental readiness infrastructure platform, including our website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration & Security
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities that occur under your account
You may not share your account credentials or transfer your account to another person without our prior written consent.
4. Service Description
Ironmind provides a mental readiness infrastructure platform that:
- Aggregates physiological signals from compatible wearable devices
- Generates readiness scores (GritScore™) based on multi-signal analysis
- Provides AI-assisted insights for stress, recovery, and sleep patterns
- Offers decision-grade readiness intelligence for performance contexts
Ironmind is not a medical device and does not provide medical advice, diagnosis, or treatment. The Service is designed for performance and wellness optimization, not medical purposes.
5. Subscription Plans & Billing
Payment Terms
Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees as described in your selected plan. Subscription fees are billed in advance on a monthly or annual basis.
Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for renewal fees.
Cancellation & Refunds
You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by law.
Price Changes
We reserve the right to modify subscription pricing with at least 30 days' notice. Price changes will apply to subsequent billing periods after notice is provided.
6. Acceptable Use Policy
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Reverse engineer, decompile, or disassemble any portion of the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Transmit viruses, malware, or other harmful code
- Impersonate any person or entity or misrepresent your affiliation
- Collect or harvest personal information from other users
- Use the Service to provide medical advice or diagnosis
7. Intellectual Property Rights
The Service and its original content, features, and functionality are owned by Ironmind and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
GritOS™, GritScore™, and GritBadge™ are trademarks of Ironmind. You may not use these trademarks without our prior written permission.
You retain ownership of your physiological data. By using the Service, you grant us a limited license to process your data solely to provide the Service as described in our Privacy Policy.
8. Third-Party Integrations
The Service integrates with third-party wearable devices and platforms (Apple Watch, Oura Ring, Whoop, Garmin). Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
9. Disclaimers & Limitations of Liability
No Medical Advice
THE SERVICE IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION.
Service Availability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONMIND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
10. Indemnification
You agree to indemnify, defend, and hold harmless Ironmind, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of third-party rights.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
